Mere days after Justice Sandra Day O'Connor announced her resignation from the United States Supreme Court, battle lines were drawn and some Democrats were threatening to impose litmus tests on any potential replacement. Senator Chuck Schumer (D-NY) said in an interview, "All questions are legitimate. What is your view on Roe v. Wade? What is your view on gay marriage?"

O'Connor has been a critical swing vote on issues like partial birth abortion and recently sided with the majority in the 5-4 decision striking down a display of the Ten Commandments.
